Terms of Service
These terms govern access to and use of HazCheckin as a platform for the operational, documentary and legal management of guest check-in.
1. Scope
These terms govern the contractual relationship between HazCheckin and professional users who use the platform to manage registration workflows, regulatory compliance and communication with authorities.
2. Service
HazCheckin provides users with a SaaS service focused on digitizing check-in and accommodation operations. Among other functions, the service may include:
- Guest document verification and identity checks.
- Generation and submission of mandatory guest reports to competent authorities.
- Automation and traceability tools for legal compliance.
3. Subscription, Term and Cancellation
Access to HazCheckin's paid features is provided as a subscription that renews automatically for periods equal to the contracted plan. In accordance with Spanish consumer law — in particular Royal Legislative Decree 1/2007 (TRLGDCU) and Law 10/2025 on customer service — the following cancellation conditions apply:
- Right of withdrawal: if you contract as a consumer, you have 14 calendar days from signing up to withdraw without giving any reason, with a refund of all payments within a maximum of 14 calendar days. If you request immediate access to the service, the refund will be proportional to the unused portion, and the right lapses once the service has been fully performed with your express consent.
- Early cancellation: you can cancel your subscription at any time, with no lock-in periods or penalties. Cancellation takes effect at the end of the current billing period: no further charges will be made and you keep access until that date.
- Simple process: cancelling is as easy as signing up. You can cancel from your customer dashboard or through the same channel you subscribed with, without obstacles or extra formalities.
To cancel your subscription early or exercise your right of withdrawal you can also write to us at support@hazcheckin.com from the email address associated with your account. We will confirm receipt and the outcome of your request.
4. User Obligations
The user agrees to use the platform diligently and in accordance with the law. In particular, the user must:
- Provide truthful, up-to-date and lawful information.
- Keep access credentials secure.
- Ensure they have a legal basis to process guest data.
5. Guest Reports and Regulatory Compliance
In connection with the submission of guest reports to the official registries (SES.Hospedajes and equivalent regional platforms), HazCheckin acts exclusively as a technology provider that generates and transmits the information on behalf of the user. HazCheckin does not carry out accommodation or tourism intermediation activities within the meaning of Royal Decree 933/2021. Accordingly:
- The user, as the operator of the accommodation activity, is the sole party bound before the authorities under Royal Decree 933/2021 and Organic Law 4/2015: the legal obligation to register and report guest data, and the administrative liability arising from any breach, rest exclusively with the user and cannot be transferred to HazCheckin.
- The user is responsible for the truthfulness, accuracy and completeness of the reported data, and for collecting it in accordance with applicable law. HazCheckin transmits the information as provided by the user or their guests, acting as a data processor on the user's behalf.
- The user must check the submission status of each report in their dashboard and keep the receipts. HazCheckin is not liable for penalties imposed on the user, nor for failures, unavailability or changes of the official platforms, without prejudice to liability that cannot legally be excluded for its own wilful misconduct or gross negligence.
6. Liability
HazCheckin will provide the service with a reasonable level of availability and security, but will not be liable for interruptions caused by third parties, connectivity issues or external official systems. The user remains responsible for the correct use of the tool and for compliance with their own legal obligations.
7. Data Protection
The processing of personal data through the platform will be governed by the Privacy Policy and, where applicable, by the data processing agreements that may apply between the parties.
8. Changes to These Terms
HazCheckin may modify these terms for valid reasons: regulatory changes or requirements from the authorities, technical, functional or security evolution of the service, changes in supplier conditions, or adjustments to plans and pricing. Any modification is governed by these rules:
- Prior notice: any modification affecting the user will be communicated by email (durable medium) at least 30 calendar days before it takes effect, describing the scope of the change and its effective date.
- Right to terminate: if the user does not agree with the modification, they may terminate the contract without penalty before the effective date, with a pro-rated refund of any paid and unused period.
- Acceptance: continued use of the service after the effective date implies acceptance of the new terms. Essential changes (such as pricing or liability limitations) will require the user's express acceptance.
9. Governing Law and Jurisdiction
These terms are governed by Spanish law. Any dispute arising from the interpretation or execution of the service shall be submitted to the courts and tribunals that apply under current regulations.
